The One Community Terms and Conditions, like everything else on our site, are open source.

 

INTRODUCTION

Welcome to the official website of One Community Inc., a 501(c)3 non-profit organization registered under the laws of the United States. These terms (“Terms and Conditions”) apply to the Site, and all of One Community’s creations, divisions, and subsidiaries which reference these Terms and Conditions. If you continue to browse and use this website, you are agreeing to comply with and be bound by this terms and conditions. We urge you to kindly review appropriately. For the purposes of this website, “we”, “us” and “our” all refer to One Community Inc. The Site reserves the right, to change, modify, add, or remove portions of both the Terms and Conditions of Use, information contained on the site and all our open source creations. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions of Use, content of this site and all our open source creations regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions, content of this site, and all our open source creations constitutes your acceptance of those changes.

You agree that if you are unsure of the meaning of any part of these Terms and Conditions or have any questions regarding the Terms and Conditions of Use, content of this site and all our open source creations, you will not hesitate to contact us for clarification. These Terms and Conditions fully govern the use of this website and all content contained herein.

 

USE OF THE SITE

You confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian. Both parties agree that this website may only be used in accordance with these Terms and Conditions of Use. If you do not agree with the Terms and Conditions of Use or do not wish to be bound by them, you agree to refrain from using this website.

We grant you the license to use this Site and all our open source creations, with the intention of sharing all the contents for the highest good of all, and in accordance with the Terms and Conditions of Use.

PROVIDED that the said license shall not include:

  1. accessing our servers or internal computer systems,
  2. interfering in any way with the functionality of this website,
  3. gathering or altering any underlying software code,
  4. and so on.

Any breach of these Terms and Conditions of Use shall result in the immediate revocation of the license granted by us without prior notice to you and without foreclosing our right of seeking redress in the court of law among others in the future. Should we determine at our sole discretion that you are in breach of any of these conditions, we reserve the right to deny you access to this website and its contents.

 

USER SUBMISSIONS

You acknowledge that anything you submit to One Community including but not limited to, questions, comments, suggestions and contributions of whatever nature (collectively, “Submissions”) is being created by you for use in a compilation and that each form of your contribution is being created by you as a “work made for hire” under the United States Copyright Act and, at all stages of development, your contribution shall be and remain the sole and exclusive property of One Community. At One Community’s sole, absolute and unfettered discretion, it may make any changes in, deletions from, and/or additions to your contribution. If for any reason the results and proceeds of your services hereunder are determined at any time not to be a work made for hire, you agree to transfer your ownership in your Submission to One Community or, should that not be possible, you agree to grant One Community a non-exclusive unlimited license on a non-royalty basis.

In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.

 

ACCESSIBILITY OF WEBSITE

Our aim is to ensure accessibility to the website at all times, however we make no representation of that nature and reserve the right to terminate the website at any time and without notice. You accept that service interruption may occur in order to allow for website improvements, scheduled maintenance, or may also be due to outside factors beyond our control, to which we shall not be liable.

 

LINKS AND THIRD PARTY WEBSITES

We may include links to third party websites at any time. However, the existence of a link to another website should not be considered as an affiliation or a partnership with a third party or viewed as an endorsement of a particular website unless explicitly stated otherwise. In the event the user follows a link to another website, he or she does so at his or her own risk. We accept no responsibility for any content, including, but not limited to, information, products and services, available on third party websites.

 

INTELLECTUAL PROPERTY

One Community’s open source philosophy carries with it certain legal risks. One such risk is that an idea originating in our materials may be later taken, patented, and sold for profit to the exclusion of others’ free use. In many jurisdictions patent protection is on a “first to file” basis, meaning it may not matter where the idea originated as long as the paperwork is filed by a certain date. Further, it allows for people to take credit for others’ creativity and hard work simply by filling out and filing a form.

To use one of our ideas while excluding others’ ability to use it goes against our philosophy, mission, and goals. A simple recourse would be to file the patent paperwork ourselves as many other open source solutions have done; however, it is a very costly endeavor and the amount of ideas and our ongoing open source content creation process makes this solution prohibitively expensive.

Thus, in accordance with our open source philosophy you agree to not use any materials gathered from this site as part of any current or future patent claim in any jurisdiction unless you are improving upon our materials with an original idea and explicitly waive all claims to our materials’ invention and protection in all documentation.

For the avoidance of doubt, and more specifically, both parties agree that all intellectual property rights and database rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and all our open source creations, shall remain at all times the property of One Community.

As part of One Community’s open source purpose and goals, we grant a non-exclusive license in all parts of this intellectual property. We do this through the Creative Commons Attribution 3.0 Unported License. This license is free and permits the use, development, distribution and replication of all of One Community’s intellectual property.

Under this license anyone is also free to exploit One Community’s Intellectual Property for profit; however, if you choose to sell any of One Community’s Intellectual Property in whole or in part you must prominently display:

  1. Credit to One Community as the originator of the Intellectual Property; and
  2. A link to where a customer may retrieve the Intellectual Property for free from One Community with a notice as to the difference in price between you and One Community.

PROVIDED that such permission for all of the above shall be subject to the following:

  1. One Community’s name, logo, and motto as they appear on this site and all our open source creations and properties, shall not be used without the prior written consent and permission of the One Community Inc. through the Executive Director,
  2. The photographs, biographies, names, and likenesses of anyone involved with One Community as they appear on this site shall not be used for any purpose without the prior written consent and permission of the owner and/or the Executive Director.

You agree to be entirely responsible for your use of any/all content of whatever nature derived from this site and all our open source creations and agree to hold us free of any/all liability arising from your use or misuse of the contents derived therefrom.

The following aspects of our site have also been chosen and specifically Trademarked to provide maximum protection for their use by us and others. Contact us for the licensing agreement required if you wish to use them:

INDEMNITY

You agree to indemnify and hold harmless One Community, our affiliates, licensees, officers, directors, agents and/or volunteers, as the case may be, from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, whether or not a breach of these Terms of Use is finally sustained. You hereby release One Community and their successors from claims, demands, any and all losses, damages, rights, and actions of any kind, including personal injuries, death, and property damage that is either directly or indirectly related to or arises from any One Community creation(s), design(s), web content, etc. and the use thereof.

 

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions of Use shall be interpreted and governed by the laws in force in the United States of America. Each party hereby agrees to submit to the jurisdiction of the courts of the USA and to waive any objections based upon venue. You further agree to waive all injunctive relief and to limit any monetary damages sought to a maximum of US $1,000 (one thousand US dollars) should a dispute arise from your breach of these Terms of Use.
