These terms (“Terms and Conditions”) apply to the Site, and all of One Community’s creations, divisions, and subsidiaries which reference these Terms and Conditions. For the purposes of this website, “we”, “us” and “our” all refer to One Community Inc. The Site reserves the right, to change, modify, add, or remove portions of both the Terms and Conditions of Use, information contained on the site and all our open source creations. At One Community’s sole, absolute and unfettered discretion, it may make any changes in, deletions from, and/or additions to your contribution. If for any reason the results and proceeds of your services hereunder are determined at any time not to be a work made for hire, you agree to transfer your ownership in your Submission to One Community or, should that not be possible, you agree to grant One Community a non-exclusive unlimited license on a non-royalty basis.
In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.
Your privacy is important to One Community. Please read the One Community Privacy Policy, which is hereby incorporated into these Terms (and which are part of our contract with you), carefully for information relating to One Community’s collection, use, and disclosure of your personal information. Among other things, our Privacy Policy explains how we treat your personal information and protect your privacy when you use our Services.
Our aim is to ensure accessibility to the website at all times, however we make no representation of that nature and reserve the right to terminate the website at any time and without notice. You accept that service interruption may occur in order to allow for website improvements, scheduled maintenance, or may also be due to outside factors beyond our control, to which we shall not be liable.
We may include links to third party websites at any time. However, the existence of a link to another website should not be considered as an affiliation or a partnership with a third party or viewed as an endorsement of a particular website unless explicitly stated otherwise. One Community’s open source philosophy carries with it certain legal risks. One such risk is that an idea originating in our materials may be later taken, patented, and sold for profit to the exclusion of others’ free use. In many jurisdictions patent protection is on a “first to file” basis, meaning it may not matter where the idea originated as long as the paperwork is filed by a certain date. Further, it allows for people to take credit for others’ creativity and hard work simply by filling out and filing a form.
To use one of our ideas while excluding others’ ability to use it goes against our philosophy, mission, and goals. A simple recourse would be to file the patent paperwork ourselves as many other open source solutions have done; however, it is a very costly endeavor and the amount of ideas and our ongoing open source content creation process makes this solution prohibitively expensive.
Thus, in accordance with our open source philosophy you agree to not use any materials gathered from this site as part of any current or future patent claim in any jurisdiction unless you are improving upon our materials with an original idea and explicitly waive all claims to our materials’ invention and protection in all documentation.
For the avoidance of doubt, and more specifically, both parties agree that all intellectual property rights and database rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to, text, graphics, software, photos, video, music, sound, and all our open source creations, shall remain at all times the property of One Community.
As part of One Community’s open source purpose and goals, we grant a non-exclusive license in all parts of this intellectual property. We do this through the Creative Commons Attribution 3.0 Unported License. This license is free and permits the use, development, distribution and replication of all of One Community’s intellectual property.
Under this license anyone is also free to exploit One Community’s Intellectual Property for profit; however, if you choose to sell any of One Community’s Intellectual Property in whole or in part you must prominently display:

You hereby release One Community and their successors from claims, demands, any and all losses, damages, rights, and actions of any kind, including personal injuries, death, and property damage that is either directly or indirectly related to or arises from any One Community creation(s), design(s), web content, etc. and the use thereof.
These Terms and Conditions of Use shall be interpreted and governed by the laws in force in the United States of America. Each party hereby agrees to submit to the jurisdiction of the courts of the USA and to waive any objections based upon venue. You further agree to waive all injunctive relief and to limit any monetary damages sought to a maximum of US $1,000 (one thousand US dollars) should a dispute arise from your breach of these Terms of Use.
